Patent & Trademark Procurement

Over the past 25+ years, we have successfully prepared and prosecuted thousands of U.S Trademark and U.S. utility, design, provisional and Patent Cooperation Treaty (PCT) patent applications before the U.S. Patent and Trademark Office and, with the assistance of our network of foreign associates, throughout the world. 

Patent and Trademark Enforcement

We help clients enforce their patent and trademark rights in the U.S. and throughout the world including before state and U.S. federal courts, before the Federal Trade Commission, before the U.S. and foreign customs offices, and before the Patent Trial and Appeal Board within the U.S. Patent & Trademark Office.

Assignments and Licensing

We have extensive experience negotiating Intellectual Property assignments and licensing agreements on behalf of both licensees and licensors.  We evaluate each transaction with an eye towards understanding potential pitfalls and ensuring the agreement properly allocates these risks.  This experience extends to employment and copyright “work for hire” agreements to make sure inventions and works developed by employees and contractors at the expense of a business remain owned by the business.

Patentablity Searches & Opinions

We work with a team of professional patent searchers, most of whom are former patent examiners, to conduct patentability searches. The searcher looks for other inventions that are similar to a client’s invention and provides us with copies of the closest “prior art” found. We compare the search results to the invention and offer our opinion on the scope of patent protection available to the client before the client invests the time of expense of pursuing patent protection.

Right to Manufacture Searches & Opinions

Our team of professional patent searches can perform a broad search in an area in which a client wishes to manufacture a particular product with an eye towards evaluating whether that product infringes other patents.  We review the results of the search and offer our opinion on the potential patent infringement risks discovered and suggest steps that may be taken to minimize these risks.

Non-Infringement Opinions

We have extensive experience analyzing competitors’ issued patents for validity and enforceability issues in light of a claim or concern that a client’s product may infringe one or more patents owned by that competitor.  Based on the results of our analyses we can pursue several potential options on behalf of the client including issuing a non-infringement opinion, which provides the client with benefits in the event patent infringement litigation arises; offering our opinion on ways to minimize risks associated with those patents including offering suggestions for “designing around” the patents at issue; and/or seeking to have the patents at issue declared invalid before the Patent Trial and Appeal Board of the U.S. Patent and Trademark Office.

About Us

John Dawson formed Dawson Intellectual Property Law to better serve clients’ Intellectual Property needs.  Prior to starting the firm, he worked in a large general practice law firm with a patent department, a small patent boutique firm, and a large national intellectual property law firm, where he worked in a variety of positions ranging from junior associate to managing partner of a local office.   Throughout his career, he has helped small, medium and large businesses as well as individual inventors with virtually every aspect of intellectual property law, including patent and trademark procurement, patent litigation, and related settlement and licensing negotiations. 

He also saw that the existing law firm structures tended to focus on attorneys being assigned individual tasks for a client. Those tasks were regularly delegated to inexperienced junior associates, many of whom never even spoke with the client.  As a result, the client’s actual Intellectual Property needs in light of their current business and financial situation were often not fully evaluated and considered when deciding the best options to pursue.

Mr. Dawson knew that it was possible to provide a more holistic approach to evaluating and providing for a client’s Intellectual Property needs.  Accordingly, Dawson Intellectual Property Law was formed to provide comprehensive, personalized service for each of its clients.  We take the time to understand their business, the financial and competitive environment in which it operates, and what can be gained by pursuing Intellectual Property protection for it.  Then, we use our extensive knowledge and experience in these areas to provide our clients with suggested options and a plan aimed at optimizing these benefits while mitigating costs.

John Dawson

John is a patent and trademark attorney based in Portland, Oregon.  He is registered to practice before the United States Patent and Trademark Office, and he is admitted to the state bars of Oregon and Washington where he is registered to appear before all state and federal courts in there. 

John graduated cum laude from Seattle University School of Law in 1991, and he received a Bachelor of Science degree in mechanical engineering from Michigan State University in 1986.

John’s practice currently focuses on all aspects of Intellectual Property Law, concentrating mostly on patent procurement, licensing and enforcement. He has over 25 years of experience in U.S. and Patent Cooperation Treaty patent application drafting, prosecution, licensing and enforcement of software, electromechanical, business method and mechanical inventions. He is experienced with client counseling and patent portfolio management for start-up, small, mid-sized and large corporations. John also assists clients with non-infringement and right to manufacture opinions.

Prior to becoming a lawyer, John worked as a senior propulsion engineer for six years at The Boeing Company in Seattle. He worked helping diagnose in-service issues arising in the Boeing 737 and 757 fleet and designing, flight testing, obtaining certification for, and implementing solutions for them. In 1990, he was awarded an engineer of the quarter award by the company for his contribution in diagnosing and proposing an efficient solution to an in-service issue that had threatened to keep operators of certain model Boeing 757’s from operating at certain airports. He was selected by the Federal Aviation Administration (“FAA”) to be an FAA Designated Engineering Representative (“DER”) for turbofan engine stability and control at the time he left the company to pursue his legal career.
